A step in the right direction, but probably a bit too subjective in the wording, which will no doubt lead to a controversy or two. Still, it's a change for the better, IMO.

I was just about to say this. If it's left to the Ref's discretion, how does the fighter know he has the right to knee the dude in the face?

If I were a fighter and I thought my opponent was putting one hand on the canvas in an attempt to get a foul (as they mentioned) and decided to KHTFO, what's stopping the ref from saying the guy was in fact a downed opponent?

IMO downed opponent should be someone that had at least a knee on the ground (and not while shooting for a TD)
This put one hand down, picking it up, and back and forth shouldn't be considered a "downed opponent".

At least they are starting to make some corrections.

This is a good change and if for nothing else but to keep dumb asses like the guy in video who got soccer kicked from trying to draw the foul, it's a bs tactic and he got what he deserved. I thought soccer kicks to the head were illegal in the UFC anyway?
