Mayhem Arrested again?

It just might be that Jason "Mayhem" Miller is back in jail again as his name appeared in the records for persons currently incarcerated with the Orange County Sheriff's Department.

A man named Jason Nicholas Miller, born December 24, 1980 is currently in custody with the Orange County Sheriff's Department. If that name and date sounds familiar it's because it happens to be shared by MMA's own Jason "Mayhem" Miller. Ariel Helwani confirmed the basics via twitter.

Fans may remember Mayhem's recent bizarre appearance on Fox News in which he talked about his new T-Shirt line and demonstrated it's customizable options with a knife he just happened to have on him at the time. He also took to Twitter last night with a not terribly out of character series of tweets that ended somewhat cryptically with this:

Hopefully more details should be coming soon. It's possible, if unlikely, that this is a case of mistaken identity. It certainly wouldn't be Miller's first brush with the law. Whatever the case check back as more information is sure to be available in the next 24 hrs.

Looks like it was attempted burglary.

This morning (August 11, 2013), Jason 'Mayhem' Miller was arrested in Orange County, California and is being held at the Central Jail Complex in Santa Ana, California. Initially details were sketchy as under California Government Code 6254(f)(1), the only way to receive an arrest report is to ask for one in person.

What we did know was that he was being held on a $50,000 bail.

MMA Mania's CJ Tuttle has learned from a source within the Orange County Sheriff's Department that Miller was arrested and charged with Attempted Burglary. Under California Penal Code 459 PC, Burglary is defined as "entering a structure with intent to commit a felony or (a petty theft) once inside."

Burglary is considered a "wobbler" under Penal Code 459 PC. This means that depending on the circumstances of the case and the individual's criminal history, they can either be charged with a misdemeanor or felony. If they are found guilty of a felony, it's a sentence of up to six years in a California State Prison.

There are some details to note regarding this case.

Miller was arrested on August 6, 2011, for allegedly assaulting his sister. The official charge was simple assault and false imprisonment. They apparently were horsing around at a party in North Carolina when he put her in a headlock and refused to let go. He was released under a $5,000 secured bond.

This also isn't the first time that Jason Miller has been arrested on a charge related to burglary. On August 13, 2012, Miller was arrested on suspicion of burglary charges after breaking into the Mission Hills Church in Mission Viejo, California. The charges were later dropped after the pastor came to Miller's defense.

If the attempted burglary charge sticks, it's likely the prosecutor will reference his previous arrests to make it a felony charge for a longer prison sentence.

I think it's both but more of the latter, like when he was talking crap about nick diaz back before he went overboard after the failed second ufc stint. Never really like him too much anyways when he got back in so i dont care

Bit more on this from :

Retired mixed martial artist Jason "Mayhem" Miller was released from Orange County Central Jail Complex early Monday morning after being arrested Sunday on domestic violence charges.

Miller posted a $50,000 bond and was released at 12:21 a.m., according to a representative from the O.C. Central Jail Complex. Sheriff's Department officials were unable to provide specifics on the arrest.

Miller has yet to publicly comment on the situation. Multiple attempts by to contact Miller have thus far gone unreturned.

Under California law, domestic violence charges range from a misdemeanor to a felony on a case-by-case basis, with the latter carrying a maximum sentence of four years in state prison.

Miller's arrest comes two days to the one-year anniversary of his arrest after being found nude inside a Southern California church. Miller allegedly broke into the church after hours, and faced a misdemeanor vandalism charge for damages within the property. However that charge was ultimately dismissed.

After losing consecutive UFC bouts and receiving his release from the promotion, Miller retired from MMA in 2012. The 32-year-old recently hinted at a comeback, admitting to Los Angeles' Fox 11 that he still thinks about fighting but will first require two corrective knee surgeries before he can consider his next move.
