In a way, it seems like he probably should be. He missed his original random pre-fight test against Lesnar, and was only granted a conditional license to fight.
Part of those conditions were to test clean in two future random tests. Of course, he failed his first random test, so you would think that would void his conditional license and make the Lesnar fight a NC.
But the NSAC only has a very limited set of conditions in which they can turn a result into a NC and it didn't foresee these circumstances so the win stands. They also can't do it ex post facto, or Barnett's win over Randy would be a NC too.
